ROBERTS, Justice. This was a suit to recover damages for personal injuries alleged to have been sustained by reason of plaintiff's slipping and falling in a bath tub in defendant's hotel, where plaintiff was a guest. The demurrer to plaintiff's third amended declaration was sustained by the trial court, and final judgment entered for defendant, from which judgment this appeal has been taken.
